The Cuyahoga County Grand Jury has, in a second decision posted today, indicted social studies teacher Timothy Mitchell on a charge of sexual battery.

The indictment follows an April 12 decision in which the grand jury declined to indict him on the same charge for conduct alleged to have occurred on June 7, 1995.

The Cuyahoga County Clerk of Courts’ website stated yesterday that the status of the case was no bill, meaning that the jury did have not sufficient cause for finding a true bill and the accused would not be indicted.

However, as of today, the website states that, in a separate case with the same charge and alleged date of offense, Mitchell was indicted yesterday and has an arraignment set for May 9 at 8:30 a.m.

At the arraignment, Mitchell will be read the indictment by the clerk of the court, unless the accused or his attorney waives the reading , according to Ohio Revised Code 2943.02.

The district sent an email today to parents and faculty in which Superintendent Gregory C. Hutchings stated, “It is with great sadness that I write to inform you that on April 25, the Cuyahoga County Grand Jury indicted Shaker Heights High School social studies teacher Timothy Mitchell on a sexual battery charge. While we cannot discuss specifics of the case, we know that it involves allegations of an off-campus incident from the mid-1990s. We have fully cooperated with police throughout their investigation.”
